Version of 9 October 2026. The version that applies to your contract is the one you accepted when the contract was concluded. It stays available at its own address. A later version applies to a contract that is already concluded only under the section Changes to these terms.

Pookie Planner and MileTribe are brand names of Max Kossatz. The brands, Apple, and Google are not the other party to the contract. Complaints go to the same address, the same email, the same phone number, or through the same form. The provider identification is in the legal notice.
These terms apply to the free use of Pookie Planner by consumers: the website www.pookie-planner.com, the web app app.pookie-planner.com, and the iOS and Android apps. There is no business offer and there are no company accounts.
An individual agreement with you prevails over these terms. Mandatory law is untouched. The description on the website explains the service. It does not replace these terms. If you download the app from a store, that store’s terms apply to the download. These terms apply to the use contract with Max Kossatz.
We have not signed up to a code of conduct.
What the contract is
Pookie Planner is a digital service for exactly two people. There is no price in money. You provide the personal data the shared account needs. What happens to the data is described in the privacy policy. Accepting these terms is not a consent to every processing operation.
The contract is for an indefinite period. Either of the two people may end it at any time, without a notice period, as described in the section Term and end.
A later offer for money is a new contract. It needs its own information before you order it. These terms do not introduce a price.
The service that is owed
What is owed is the shared account for the two people, the jar of ideas, the calendar with dates, invitations, and open days, and hearts, reactions, and comments. What you have saved with those is part of it, including a place, a phone number, or a link on an idea.
What is not owed, and a failure of which does not make the contract defective, is weather, suggestions of new places, the voice assistant, the map, and Discover. The app stays usable without these functions. The assistant runs only if you allow it yourself.
We do not promise a percentage of availability. The owed part should be reachable in ordinary operation. Maintenance and outages can interrupt it. These terms add no legal consequence beyond the statute.
We do not owe any use without an internet connection.
Departure from the usual quality
The app is in ongoing development. Even the owed functions can be incomplete, can change, or can work less reliably than you could usually expect from a finished couple planner. That is a departure from the objective requirements of a digital product.
You agree to this departure expressly and separately, not by this text alone. It is the last sentence of the acceptance box, together with the link to these terms, the privacy policy, and the withdrawal notice. The box is not pre-selected.
On the German screen the sentence reads: „Mir ist klar, dass die App in laufender Entwicklung ist, und selbst Kernfunktionen können einem fertigen Paarplaner nicht entsprechen.“
On the English screen it reads: “I know the app is in ongoing development, and even core features may not match a finished couple planner.”
The person who creates the account ticks the box before sending the registration. The second person ticks it at first use. Without the tick, that person’s contract is not concluded.
The statutory rights on defects remain. They are limited only so far as you have agreed to this departure.
Technology and updates
You need an internet connection. For the native app you need the current version, once it is offered in that store. For the web app you need a current browser. We do not owe older environments. We do not publish a list of operating-system or browser versions. If a version can no longer be used, the app says that an update is required.
We provide security updates, and updates that keep the service in conformity, during the term of the contract. After the contract ends there is no fixed update period. If you do not install a necessary update, the app may stop working or work only in a limited way.
We may change the service when there is a valid reason. The reasons are security, a legal duty, technical necessity, disproportionate effort to keep the current state, and further development of the owed functions. The change costs nothing. Weather, place suggestions, the voice assistant, the map, and Discover may be removed or replaced.
If a change impairs access or usability more than only slightly, we inform you by email on a durable medium in time for you to end the contract before the change, and also in the app. The email names the change, the time, and the right to end the contract free of charge. You can end it as described in the section Term and end. The statutory right to end the contract on such a change remains in addition.
Account and age
An account belongs to two people. Both must be at least 18. Each person gives their own date of birth. We calculate age on the calendar day in the time zone Europe/Berlin.
The person who creates the account is checked at registration. If they are under 18, no account is created. The second person is checked at first use. If they are under 18, they get no access. The account of the person who created it remains. There is no procedure for legal representatives, because minors are excluded.
At registration, the person who creates the account gives their own email address, their own date of birth, both first names, and the passwords, and may give the second person’s email address. The second person has no access until they sign in, give their own email address and date of birth, accept the legal texts, and use the app. There is no guest access.
The information must be correct. Knowingly false registration information ends the contract immediately, without a prior warning, on the path in the section Block.
You keep the password secret. Several couple accounts are allowed. Each is its own contract. An account and this contract cannot be transferred and cannot be resold.
There is no way for one person to leave and keep the account for the other. Deletion or withdrawal by one person ends the contract and the account for both.
Conclusion of the contract
The language of the contract is German. The app’s interface may be English. The German text of these terms applies to the contract.
Person who creates the account. You fill in the registration and can change the fields before you send them. Sending is your statement aimed at the contract. The contract is concluded when the account is created in that step. That happens automatically. There is no separate approval by us. You can use the app after that.
Second person. The contract with them is concluded only at first use: sign-in, acceptance of the legal texts, start of use. That is both their statement and our automatic acceptance. Before that, they are not a party and have no access. If the person who creates the account gave an address, we send an invitation email. That email alone does not conclude the contract with the second person.
Without undue delay after that, we send a confirmation by email, to the person who creates the account at the account address, and to the second person after first use at their own address. The email contains the links to the version of these terms, the privacy policy, and the withdrawal notice that then applies, each with its date. We meet the same duty where the statute requires a confirmation on a durable medium.
We store the accepted version on the account. The current text is at /legal/terms. Older versions stay available and savable at /legal/terms/ plus their date.
You correct entries in the form before you send it. Afterwards you can change your own profile data in the app and reset the password.
Price
No price in money is agreed. Tax on a price does not arise, because there is no price. There is no trial, no subscription, no automatic renewal for money, and no in-app purchase. There is no personalised price.
Right to use
You receive a simple, non-transferable right to use Pookie Planner during the term of the contract, worldwide, privately, on your own usual devices, for the two people on this account. Commercial use is not allowed. Max Kossatz remains the holder of the rights in the app.
You use the app as provided. Your own distribution copies, passing the app on, and resale are not allowed. For the native app, the store is the intended path once the app is offered there.
Statutory permissions, including to make a copy for your own use, remain where they are mandatory.
Your content
What you write into the account stays yours. You do not grant us an exclusive right in it, and you do not transfer ownership of it.
During the term we may store this content, show it to the two people, and back it up, and have it processed by the service providers that run the product. Who they are is set out in the privacy policy. Those providers may process the content only for that. There is no passing on for advertising, for public examples, or for training a model.
On the block, this use for the contract ends. Text that remains afterwards is not published, and we do not train a model with it. What remains, and how you can ask for deletion, is described in the section Term and end and in the privacy policy.
Prohibited use
The following is not allowed:
- scraping, meaning automatic collection of the service beyond ordinary use by the two people,
- resale or passing on of an account,
- abusive load on the voice assistant or place search, meaning use that is meant to overload those functions or that clearly goes beyond private use by the two people,
- circumventing an access block,
- unlawful content in the account.
There is no general monitoring of the private content. We do not read the planning in order to moderate it. The content stays with the two people. There is no public community and no marketplace.
Block
If you breach the section Prohibited use, or if registration information is knowingly false, we block the account immediately and without a prior warning. The service ends for both people. Both are signed out.
The grounds are sent by email to the address with which the account was created, and to every other address already stored. If the second person’s address is not stored yet, the message goes only to the account address. The provider decides on a block, not an automatic program. Technical limits against too many attempts can apply automatically without ending the account.
We do not restore a block. There is no internal complaint body. Statutory routes, including to courts and authorities, stay open. If the block was not justified, your statutory claims remain.
What happens to the data after that is the same as for deletion and withdrawal, in the section Term and end.
Reporting unlawful content
You can report unlawful content to support@pookie-planner.com or through /contact. There is no separate reporting form.
We review the report and tell the person who reported it about our decision, where the law requires that. A person who is blocked receives the grounds on the path in the section Block.
Defects, contact, no guarantee
The statutory rights on defects apply to the digital service. We give no voluntary guarantee. A store refund of a price is not a remedy under this contract, because nothing is sold through the store.
Contact for support and complaints: the email, the phone number, and the form in the section Provider and scope. We do not promise a reply within a stated number of hours. The form is read within a few working days. Feedback inside the app is not a public support channel.
Liability
Our liability is unlimited in cases of intent and gross negligence, injury to life, body, or health, under the Product Liability Act, to the extent of a guarantee we have assumed, and for fraudulent concealment of a defect. The same applies where a statute orders liability that cannot be modified.
For slight negligence we are liable only for breach of an essential contractual duty, and only for the damage that was foreseeable when the contract was concluded and typical for this contract. Essential means a duty whose performance makes the contract possible in the first place and on whose observance you may regularly rely. Otherwise, liability for slight negligence is excluded.
These limits also apply to people we use to perform the contract. The limits do not take away the statutory rights on defects.
Term and end
The contract runs for an indefinite period. There is no notice period. There is no termination process separate from ending the account.
Either of the two people may end the contract at any time, without the other’s consent. The paths are the button in the app, the page /withdraw, a letter, or an email, as described in the withdrawal notice. Within that person’s own 14 days, that is withdrawal. After that, the same paths end the account. The statutory right of withdrawal no longer exists then. Access ends the same way in both cases.
If the second person has not concluded the contract yet, the account still ends. That person cannot conclude it afterwards.
On the end you must stop using Pookie Planner and must not make it available to anyone else. We block access immediately. Both people are signed out. We do not refund a price, because none was paid. There is no automatic export. A copy on request is described in the privacy policy.
At the earliest 20 days after the block, we overwrite names, email addresses, the stored home, the place used for the forecast, and the password. We do that only once the email about the end of the account has been sent to every stored address. Until then those details stay, even if the 20 days have already passed. A block notice, and the name and email from the withdrawal form on the website, are overwritten or cleared in the same step.
This path does not delete everything. The date of birth stays on the record. We do not delete text you wrote in the app at that point. That includes ideas, dates, comments, and feedback. If such a text contains something about a person, it can remain there. We do not call that remainder anonymous. There is no further use for the contract. We do not publish those texts and do not train a model with them. If you ask for deletion of that remainder, we delete it. What else remains is set out in the privacy policy.
We do not remove backups and logs at the moment of the block. They fall away with the next ordinary rotation, at the latest after 90 days. The same applies to copies that remain with the service providers that run the product.
Withdrawal
You have a statutory right of withdrawal. The period, the form, and the effects are set out in the withdrawal notice. The model withdrawal form is not obligatory. The electronic withdrawal function is at /withdraw and, while you are signed in, in the app.
The 14 days run for each person from their own conclusion of the contract: for the person who creates the account from registration, for the second person from first use. Either person may withdraw alone. The contract then ends for both.
We provide the service from the conclusion of the contract, so before the period expires. The right of withdrawal does not end because of that. There is no statement by which you give the right up. We do not claim compensation for use during the period.
Changes to these terms
We publish a new version under a new date. The old one stays available. The version stored on your account does not change merely because of the publication.
We inform you of a change by email, to the account address and to every other stored address, and by a notice in the app. The change applies 30 days after that information, if the account is still used after that. Continued use counts as agreement to the change we told you about.
That does not apply where the statute requires an express and separate agreement for the change. Silence does not replace that agreement. A change to these terms does not take away mandatory rights and does not introduce a price.
Either of the two people may object before the change applies. The objection goes to support@pookie-planner.com. The information names this path again, including in the app. An objection ends the contract for both, on the path in the section Term and end.
Privacy
The processing of personal data is described in the privacy policy. These terms do not replace it.
Emails about new features and offers are a separate switch, not pre-selected. The assistant and crash reports have their own switches. None of that is given by the acceptance box for these terms.
Stores
For a download from the Apple App Store, Apple’s standard EULA applies so far as Apple applies it to the download. For a download from Google Play, Google’s terms apply to that download. These terms apply to the use contract with Max Kossatz.
If the texts conflict, mandatory law applies. Otherwise the store terms apply to the download and these terms apply to use. We do not file custom end-user terms with Apple. In the store the app is called Pookie Planner. The seller of the use contract remains Max Kossatz.
There is no payment, no subscription, and no refund through the store. The minimum age in the store listing must match these terms: 18 and over only.
Law and disputes
The law of the Federal Republic of Germany applies. Mandatory consumer-protection rules of the state where you have your habitual residence remain in force. We do not agree a place of jurisdiction against consumers. The statutory place of jurisdiction remains.
The provider is neither willing nor obliged to take part in dispute resolution proceedings before a consumer conciliation body.
Closing
If a clause is invalid, the rest of the contract stays in effect. The statute takes the place of that clause.
