Pookie Planner is a digital service for two people. There is no price in money. You provide personal data. The other party to the contract is Max Kossatz. MileTribe and Pookie Planner are brands, not separate parties. The contract is for consumers.
Instructions on withdrawal
Right of withdrawal
You have the right to withdraw from this contract within 14 days without giving any reason.
The withdrawal period will expire after 14 days from the day of the conclusion of the contract.
To exercise the right of withdrawal, you must inform us (Max Kossatz, Freiberger Straße 4, 01067 Dresden, Germany, telephone: +49 171 3452085, email: support@pookie-planner.com) of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or email). You may use the attached model withdrawal form, but it is not obligatory.
You may also exercise your right of withdrawal online at https://www.pookie-planner.com/withdraw. Signed in, in the app, it is under Settings, section “The two of you”, button “Delete our account and withdraw from the usage contract”. If you use this online function, we will communicate to you an acknowledgement of receipt of such a withdrawal on a durable medium (e.g. by email) without delay, including information on the content of the withdrawal as well as the date and time of its receipt.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Effects of withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.
The reimbursement paragraph is the statutory model wording. This contract has no price in money. As long as we have received no payment from you, there is nothing to reimburse. We do not claim compensation for use during the withdrawal period.
The right of withdrawal does not end early merely because the app can be used before the period expires. There is no statement by which you give the right up.
Who the period binds
The parties on your side are the two people on the account, each on their own. The couple is not a legal person of its own.
The 14 days run for each person from their own conclusion of the contract.
- For the person who creates the account, that is the day of registration.
- For the second person, that is the day they conclude the contract. That is the day of first use. They sign in, accept the legal texts, and start using the app. Before that, no period runs for them.
Either person may withdraw alone, without the other person’s consent. The contract then ends for both. If the second person has not concluded the contract yet, the account still ends. That person cannot conclude it afterwards.
After that person’s own 14 days, their statutory right of withdrawal no longer exists. A letter, an email, the page at /withdraw, and the button in the app still end the account after that. That later end is an end of the account, not the statutory right of withdrawal. Access ends the same way in both cases.
How to withdraw
An unequivocal statement is enough. The model form is not obligatory. A phone call to +49 171 3452085 is enough if it is clear that you are withdrawing. The contact form is not the withdrawal function. An unequivocal statement that reaches us still counts, including when the form forwards it to support@pookie-planner.com.
Letter or email. Letter to Max Kossatz, Freiberger Straße 4, 01067 Dresden, Germany. Email to support@pookie-planner.com. The deadline is met if you send the statement before the period expires.
Without signing in, on the website. Open https://www.pookie-planner.com/withdraw. The button is labelled “Withdraw the contract”. You enter your name and an email address. An email with the next step is sent to that address only if it is stored on the account. We do not say whether an account exists for that address. The link in the email works for 60 minutes and only once. Only the button “Confirm withdrawal” on the following page is the withdrawal statement. Filling in the first form alone does not withdraw. The deadline is met if you send “Confirm withdrawal” before the period expires. If the link expires, you can request it again within the period.
In the app, while you are signed in. Tap “You” at the top, then “Settings”. In the section “The two of you”, use “Delete our account and withdraw from the usage contract”. That button only opens the question. It is sent with “Delete and withdraw”. On the German screen the steps are „Du“, „Einstellungen“, „Ihr zwei“, „Unser Konto löschen und Nutzungsvertrag widerrufen“, and then „Löschen und widerrufen“.
The acknowledgement of receipt arrives by email, on a durable medium. It states the content of the statement and the date and time of receipt. It is sent to the email address with which the account was created, and to every other address already stored on the account. If the second person’s address is not stored yet, the message goes only to the address with which the account was created.
What happens to the account and the data
On withdrawal you must stop using Pookie Planner and must not make it available to anyone else.
We block access immediately. Both people are signed out.
At the earliest 20 days after the block, we overwrite names, email addresses, the stored home, the place used for the forecast, and the password. We do that only once the email about the end of the account has been sent to every stored address. The date of birth stays on the record. We do not delete text you wrote in the app at that point. That includes ideas, dates, comments, and feedback. If such a text contains something about a person, it can remain there. There is no export of this content on withdrawal.
We do not remove backups and logs at the moment of the block. They fall away with the next ordinary rotation, at the latest after 90 days. The same applies to copies that remain with the service providers that run the product.
